RALEIGH -- Education advocates in North Carolina filed suit against the state - calling the Opportunity Scholarship program passed by the General Assembly in the last session "unconstitutional" and saying it will "undermine student success by undercutting public schools." Rodney Ellis with the North Carolina Association of Educators says that will siphon needed money from public schools already trying to do more with less.

Ellis said, "The actions that they took were extreme. And it forces us to take extreme measures, in order to ensure the safety and quality of public education in North Carolina. So, extreme is as extreme does."

However, Darrell Allison with the Parents for Educational Freedom - says the Opportunity Scholarship Program meets legal requirements, "The United States Supreme Court has ruled on it in 2001, that this type of scholarship program is constitutional if constructed the right way. We have a number of other states that have ruled on it."

The lawsuit was filed in Wake County and seeks an injunction to prevent the voucher laws from going forward.
