WASHINGTON -- The Supreme Court will hear arguments Monday over regulations by the Environmental Protection Agency on new power plants. Under the Obama administration legislation was adopted to limit the carbon emissions allowed at new facilities. Jonas Monast, Director of the Climate and Energy Program at Duke University, says they are making these limitations based on the Clean Air Act.

Monast said, "The EPA is regulating greenhouse gas emissions from motor vehicles, from cars and trucks. Second, the EPA is requiring any new large industrial facility that emits over 100,000 tons per year, of greenhouse gases, to get an air quality permit."

The disagreement seems to be down party lines with many Republican-led states disputing the EPA's authority to enforce these regulations and left-leaning states siding with environmentalists.
