Governor Vetoes Magistrate Opt Out Bill

RALEIGH – Gov. Pat McCrory said Thursday he will veto the bill passed by the General Assembly that would allow magistrates and other court officers to opt out of performing marriages because of “religious convictions." related to gay marriage. This sets up a showdown with the Republican Governor and the legislature with a majority of his own party. "I recognize that for many North Carolinians, including myself, opinions on same-sex marriage come from sincerely held religious beliefs that marriage is between a man and a woman. However, we are a nation and a state of laws,” McCrory said a brief statement issued only hours after the bill’s final approval in the State House.

“Whether it is the president, governor, mayor, a law enforcement officer, or magistrate, no public official who voluntarily swears to support and defend the Constitution and to discharge all duties of their office should be exempt from upholding that oath; therefore, I will veto Senate Bill 2."

The legislature can with a two-thirds majority override the veto. While both houses have the Republican majorities necessary to achieve such a vote, there has been some concern stated that the house may be a few votes short to meet the threshold.

This marks Governor McCrory’s first veto of this legislative session.
